SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

First, we don’t sell your personal information to anyone. Second, we don’t ask for your personal information unless we need it to provide or improve the services we provide. Third, we don’t share your personal information unless you’ve specifically allowed it, or for the very limited purposes described below. Finally, we appreciate that when you use our services, you trust us with your information, and we take that responsibility very seriously. This Privacy Policy holds us accountable for protecting your rights and your privacy.

1.1 Payment Information. When you initially provide or update your payment information, we transmit it via an encrypted connection to our Payment Processor, Flipcause uses and processes your payment information in accordance with Flipcause’s Privacy Policy. We don’t store your payment information, other than your zip code and country, which we require for billing and to comply with tax and other government regulations.

1.2 Communications With Us. When you send us emails or other communications, such as customer support inquiries, we maintain those communications and their contents so that we can resolve your inquiries or otherwise assist you.

1.3 Public Comments On The Services. We maintain any comments, contributions to discussions or messages submitted to users of the services, in order to provide the services.

SECTION 2 - COMMUNICATIONS

We may periodically email you service-related announcements. We'll also send you emails related to your transactions. We may also send you marketing or promotional communications, but you can opt out of receiving subsequent marketing or promotional communications by clicking the link marked unsubscribe (or a similar phrasing) that’s included in those communications.

SECTION 3 - CONSENT

3.1 How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card or make a donation, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

3.2 How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at publicrelations@artsbusinesscollaborative.org

SECTION 4 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL). Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 5 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

ABC is a 501(c)3 technical assistance and research organization with a mission to improve quality of life for people of color through the arts and STEM. Our services focus on the underlying factors that impede their creative and professional endeavors: access to capital, networks, and training.

ABC aims to systemically improve the quality of life in communities of color through two main services: the Grassroots Action Project and the Rising Tides Research Institute.

These resources will be easily accessible, useable, and available through these websites in an open source fashion whenever possible. The following terms and conditions have been developed with these principles in mind but there are limitations. Access to and use of this Web site and all other sites produced by ABC (“the Sites”) is provided subject to the following terms and conditions.

PLEASE READ THESE TERMS CAREFULLY AS YOUR ACCESS AND USE OF THE SITES CONSTITUTES AGREEMENT TO ALL TERMS, CONDITIONS AND NOTICES CONTAINED OR REFERENCED HEREIN.

Terms and Conditions of Use

By using the Sites, you are deemed to have agreed to these terms and conditions of use. ABC reserves the right to modify these terms at any time. You should check these terms and conditions periodically for changes. By using the Sites after we post any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these terms and conditions of use, please do not use the Sites. All content on the Sites is subject to change without notice. ABC reserves the right, in its sole discretion, to terminate your access to all or part of the Sites with or without notice. ABC may change, suspend or discontinue all or any aspect of the Sites at any time, including the availability of any feature, database, or content (including interactive areas), without prior notice or liability.

Scope of Terms and Conditions

These terms and conditions apply to your use of all of the sites and services owned or operated by ABC. These terms and conditions do not apply to your use of those sites to which the Sites links.

Use of Materials Posted on the Sites

It is the intention of ABC to make its resources as accessible and usable as possible. Therefore, unless otherwise stated, all ABC resources are available under a Creative Commons Attribution-Noncommercial-Share Alike license. Unless otherwise stated, you may print, download, reproduce, distribute, publicly perform and/or publicly display all ABC resources for non-commercial, educational use provided they are credited to ABC and, where applicable, the organization or person who developed the resources. You may make adaptations of or modifications to ABC resources for non-commercial, educational purposes, again provided the derivative work is properly attributed and is “shared alike”—available to others under the same license that governs the original work.  Nothing herein shall grant intellectual property rights to ABC’s logo, trademark or copyright to anyone other than ABC and shall remain its sole and exclusive property.

ABC’s resources are protected by copyright and trademark laws, and are the property of ABC and any affiliated organizations.

Credits

We encourage others to both use and adapt our resources and products. However, all products must be appropriately credited. Where applicable, this acknowledgement should follow the copyright notice. ABC requires that an acknowledgement of support and a disclaimer appear in publications of any material, whether copyrighted or not, when the work is based on or developed under ABC-supported projects.

ABC resources and products must include the ABC logos and acknowledgment, with the URL (www.artsbusinesscollaborative.org) as a live link in digital environments:

“Developed for Arts Business Collaborative. Any opinions, findings, and conclusions or recommendations expressed in this report are those of the authors and do not necessarily reflect the views of the Organization.”

Any adaptations or modifications of ABC resources and products should be credited in the following manner:

Any opinions, findings, and conclusions or recommendations expressed in this report are those of the authors and do not necessarily reflect the views of the Organization”

Permitted Use

You may not reproduce, record, publish, modify, or distribute any ABC resources or products for commercial purposes. Requests by the Media for use of any image should be coordinated through PublicRelations@artsbusinesscollaborative.org.

Some examples of prohibited use:

• Including ABC resources or products, or reproductions of ABC resources or products, in a commercial publication or product to be sold or provided in exchange for a fee,• using ABC images to promote a commercial program, product, event, or activity,• serving ABC web pages on your web site,• using a ABC photo, video, directory, publication, or other product without properly crediting the person or groups that developed the product, ABC whether for educational or commercial purposes.

Rules of Conduct

You shall not post on the Sites any content which is libelous, defamatory, obscene, pornographic, abusive, harassing or threatening, contains viruses or other contaminating or destructive features, violates the rights of others, such as content which infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity, or otherwise violates any applicable law.

You may post links to external Web sites on the Sites, with the understanding that ABC does not approve or condone in any way the content linked to. ABC may, for any reason, remove external links from the Sites. The Sites may not be used by you for any commercial purpose, to distribute any advertising or solicitation of funds or goods and services or to solicit users to join competitive online services.

Links to the Sites

ABC welcomes links to the Sites. Permission to create a link to the Sites is not required. However, we do reserve the right to request removal of a link from any Web page we believe does not further the ABC’s mission. You may NOT enclose pages from ABC Web site within a frame set on your site.

The Sites may provide links and pointers to Internet sites maintained by others. ABC is not responsible for the availability of any other site to which the Sites link. Nor does ABC endorse or take responsibility for the content, advertising, products or other materials made available through any other site. Under no circumstances shall ABC be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any content, goods or services available on any other site.

Trademarks

Arts Business Collaborative, artsbusinesscollaborative.org, and their logos, are trademarks of ABC. Adaptations or modifications of ABC resources or products (“third party works”) shall be appropriately credited, however, ABC trademarks may not be used in connection with a third party work in a manner that is likely to cause confusion among users.

Submissions

ABC is not responsible for material appearing on any message board, chat room, photo- or video- sharing service, or similar interactive service appearing on the Site. ABC is not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other reason. We do, however, retain the right to modify or remove messages or other material that we, in our sole discretion, consider infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. We also reserve the right to edit materials for any other reason. Whether or not we modify or remove such material, users remain solely responsible for the content of their own messages or postings.
